Rape Story

The Internet is the repository for many stories. Some funny, some childish and some full of hope. And more often than not, it also holds stories that are truly heartbreaking. This is the story of Gopal Shetye, a Graduate in Hotel Management of Mumbai.

 

On 29th July, 2009, Gopal Shetye was arrested for the rape of a woman in Mumbai. The reason for his arrest? The man who forced himself on the woman called himself “Gopi”.

As reported by The Logical Indian, the woman in question had arrived in Mumbai from Aurangabad in January 2008, initially serving as a maid in Kalyan before resorting to begging on the streets. On the 18th July, she left Kalyan towards Mumbai and spent the day begging at a station. At 2:30 A.M. on the night after she arrived, a person approached her claiming that he loved her. He only gave her his name as Gopi, before forcibly dragging her away and raping her. After the incident he took her by auto to a local hospital to have her tended to, before fleeing when the police showed up at the scene.

 

And this is where the case truly gets terrifying. The victim was asked to identify the accused before the Test Identification Parade.

 

The victim’s statement identifying Gopal as the rapist was never recorded in court.

 

The arrest was made on the basis of CCTV footage. However, the footage itself was never submitted in court or brought on record as evidence.

 

The auto rickshaw driver who drove both the rapist and the victim to the hospital was never called for identification or to testify.

 

Even the hospital staff who had interacted with the both of them were not called.

 

None of this mattered, as Gopal was sentenced to seven years in jail. Two applications for bail fell on deaf years.

As Gopal rotted in prison, his family fell apart. His father passed away, his wife remarried (with his consent) and his children were sent to live in an orphanage. He even contracted tuberculosis while in prison.

Gopal has now been released a full 3 months after he completed his 7 year sentence.

 

But being proven innocent is scant consolation after 7 years in prison. Gopal is now sitting on hunger strike at the Azad Maidan to seeking to meet Chief Minister Devendra Fadnavis. I want seven years of my life back. I demand justice”, said Gopal when he spoke to India Today.

 

 

Gopal is free, but his life will never be the same. In the rush to close a case, the police failed to do their duty. And with regards to the original Magistrate’s sentencing, whatever happened to innocent until proven guilty? Or does that only apply to the rich and famous of our country?

“It’s been years. I don’t feel the pain in my vagina anymore”.

“But why didn’t you tell anyone?”

“I was shocked. Ma used to see my vagina bleed, she never did anything. So, I thought it’s something to be done regularly. I was 7 then. I am 20 now.”

She opened her purse to buy Candy Floss. I could see condoms in her purse. I didn’t ask anything, I knew she’d tell me everything. After all, she was going to be engaged with my brother.

“He didn’t stop them because he wanted to earn without working and I was the only option for him, even though he didn’t let any other man touch me BUT my relatives and he claims that with pride.”

“Why the hell didn’t you go to the police, Shruti?”

“Because when I tried doing something, I was asked how my boobs were grabbed and I was asked to demonstrate, and then…”

“AND THEN?”

“I was asked to strip and show them the marks.”

I noticed tears rolling down her eyes. She is one of the most over-excited women you’ll ever meet. Always smiling and always jumping, and always smoking. Always with no gaps.

“And then?”

“Regularly hota aya hai na. Hota gaya. I crossed my puberty. My school was very strict and I had no friends. Kisko bolti? My own parents betrayed me. You think my school would have helped me?”

“Look, I am going to write for this site that’s going to publish this story. I want you to tell me everything so that we can stop another Shruti.”

She paused. Lit another smoke, gave one to me.

“I was 7 when I was raped. My mother served him tea in the very room. My dad took money from him. I was in pain. Something below my stomach was paining and I couldn’t understand anything. Next day, Mama had come over. I was so happy. He entered my room with Nutties and raped me just like Kaka did. He held my breasts so hard and then he put fingers in my vagina, and it was hurting me so much.”

“I wanted to run away, I was crying and screaming, he penetrated something and I felt like I was dying and then I was lying on the floor, naked. My pet, Tito, licked my head and arms and sat there, without barking. This continued. Just because they wanted to derive pleasure, I was raped by Kaka and Mama on the very same day just before my exams. My vagina bled, days after days. I didn’t feel the pain anymore. Their penises were so familiar and so friendly, yet so unwanted. I was always ready with my legs spread, with my clothes off my body. Baba and I hardly spoke then. I couldn’t tolerate them. In fact, I was pregnant and I was asked to choose abortion, obviously!”

“How are you now?”

“I am awesome. I am getting married which was something I always wanted to avoid. A man fell in love with this torn body which has been used in every way by many men. SEX, not love. Now, I am getting the love I deserve and that makes me smile. I have left them now, I live with my friends and I am happy.”

“Why don’t you file a complaint against them?”

“I can’t. Baba is involved. Let them be. I am strong enough to stop another me. Police kya karegi? Just like you are penning down and recording, others will too and this will spread. Laws in this country will not help you, you can help yourself, you can help others, and authorities will NOT DO ANYTHING.”

“What are your plans in the future?”

“Hahaha. I am going to complete my degree here. Get married, continue my studies abroad and then work with Raj.”

“How many babies do you want?”

“I will never have kids. I have complications. I have been raped more than 30-40 times, I can never have babies, but I want to adopt so many dogs and so many cats and live happily… HAPPILY”.

A pack of smokes got over. We exchanged a very deep look. I hugged her and she left for work. She has grown up with men in her family exploiting her breasts and vagina in every possible dirty way. No, not that she isn’t raising her voice against them. She is doing the necessary by talking to people who are willing to share her experience but she doesn’t wish to penalise them because she loves her parents. She works with NGOs now and she is studying Psychology too.

She is smiling but do we really know the intensity of the “Stop! Help me!” behind her smile?

Today, he abuses, beats, and RAPES his own wife until all his pent-up frustration has been vented and starts his day fresh as a transformed member of society. And guess what! The neighbourhood couldn’t be more thankful. Rana Bhaiyya is no more a threat to society! Problem solved!

Are you feeling disgusted? Why? What’s so unnatural about the whole story? Do you feel the girl in question was used as bait? Do you think Rana Bhaiyya is an animal who deserves to die alone? But why? I mean c’mon! He is legally wedded to the girl and the Indian law provides him with every right to derive any kind of pleasure he wishes from the marriage- emotional, financial or sexual. If you don’t believe me, sample these legal provisions:

Sexual intercourse by a man with his own wife, the wife not being under fifteen years of age, is not rape.

Well, if you are still not convinced with the legal arguments, allow me to take the moral route and convince you by reiterating the sacred vows that most Indian brides exchange during their wedding:

4th vow of marriage:

I will shower you with joy, from head to toe. I WILL STRIVE TO PLEASE YOU IN EVERY WAY I CAN.

5th Vow of marriage:

Your happiness is my happiness, and your sorrow is my sorrow. I will trust and honor you, and will strive to fulfill ALL YOUR WISHES.

7th vow of marriage:

I will love you solely for the rest of my life, as you are my husband. I VOW TO REMAIN CHASTE.

So why is there such a hue and cry about Indian government not penalising marital rape? For ages now, we have been raised to believe that Indian marriages are made in heaven and that the wedded husband is equal to God. And you better not refuse God. What we are not told is that most often the core concept of Indian marriages is nothing but a glorified barter system where women trade their virginity and sexual services in return of financial care. And the spaced-out legal rulings are just leading this wonderful and superb institution of marriage to decay even more.

The problem of marital rape does not only concern the Rana Bhaiyyas of India but stems equally out of the mental conditioning that Indian parents impart to their kids, irrespective of their gender. It starts from the concept of mandatory sex on the first night and goes on throughout the life because hey, isn’t marriage a free pass to have sex?

So if it is so clear at a human level, why doesn’t the Indian government understand?

To take an action against something, we need to accept its existence in the first place. If marital rapes are to be stopped in India, our country has to stop living in denial and wake up to the fact that it can ACTUALLY HAPPEN ANYWHERE- in your neighbourhood, at your relatives’ place and however uncomfortable it might sound, at your own place.

But we won’t realise that! You know why? Because we are too patriarchal to accept marital rapes. The acceptance of this phenomenon simply blows away our comfortable lid and exposes the ugly underbelly of our society. This very same society holds women responsible for not obeying their husbands, blames them for forced abortions and turns a deaf ear to the screams next door, simply because pleasure and pain, will and force is weighed in India by our marital statuses. Such a society is incapable of understanding marital rape.

In the times when India is shamed all over the world for being a horrid place for women due to rampant rapes, at least marital rapes could be stopped considering that the attacker here is very well known. In fact, according to a study, the number of women sexually assaulted by their husbands is 40 times the number of women attacked by men they don’t know.

Yet, marital rape is legal in India. What’s even abhorring is that even the rape of a man or a transgender is punishable under the section 375 of IPC, so why does marriage take away all human rights from the women?

If out of the 200 countries in the world, more than 100 countries can penalise marital rapes then why can’t we safeguard the women of India? I am all for the more open and fair discussion of legal ramifications of a law which penalises marital rape, however not doing anything about it due to the fear of it being misused is equally inhumane.

No accepted marital norms or the possibility of legal loopholes can ever justify marital rape and Indian govt. better understand that soon. In fact, rape in any of its form should not be tolerated- not even if you have signed a marriage certificate with your rapist or share your bed with him and never because you call your rapist your HUSBAND.
